Stats Perform is committed to protecting your personal information and respecting your privacy in accordance with applicable laws. This Privacy Notice explains who we are, how we collect, share and use personal information about you, and how you can exercise your privacy rights.

This Privacy Notice is issued on behalf of the Stats Perform group of companies which includes (together with their respective subsidiaries):

(together “Stats Perform”, “us”, “we” or “our”). We are the data controller of any personal information we collect about you and we are responsible for: www.statsperform.com; www.soccerway.com; www.scoresway.com; www.automatedinsights.com; www.optasports.com www.theanalyst.com and www.thuuz.com as well as any other websites owned and operated by Stats Perform from time to time (together the “Websites”).

We have appointed a data protection officer (“DPO”) who is responsible for overseeing questions in relation to this Privacy Notice. If you have any questions about this Privacy Notice, including any requests to exercise your legal rights, please contact the DPO using the details set out below.

What does Stats Perform do?

Stats Perform is a sports technology company providing sports data and the latest advancements in applied AI and machine learning headquartered in London and Chicago. Our products and services deliver world leading sporting predictions for teams and sportsbooks and a more engaging broadcast, media and fan experience. Stats Perform is a global organisation with offices and operations located around the world including the US, UK, Europe, Asia, South America and Australia.

We are committed to protecting and respecting your privacy.

Information we collect from you and why

Personal information, or personal data, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymised data). The table below sets out in detail the personal information that we may collect about you, which broadly falls into the following categories:

Who does Stats Perform share my personal information with?

We may disclose your personal information to the following categories of recipients:

  • to our group companies, third party services providers and partners who provide data processing services to us (for example, to support the delivery of, provide functionality on, or help to enhance the security of our Website), or who otherwise process personal information for purposes that are described in this Privacy Notice or notified to you when we collect your personal information;
  • to any competent law enforcement body, regulatory, government agency, court or other third party where we believe disclosure is necessary (i) as a matter of applicable law or regulation, (ii) to exercise, establish or defend our legal rights, or (iii) to protect your vital interests or those of any other person;
  • to a potential buyer (and its agents and advisers) in connection with any proposed purchase, merger or acquisition of any part of our business, provided that we inform the buyer it must use your personal information only for the purposes disclosed in this Privacy Notice; and
  • to any other person with your consent to the disclosure.

Legal basis for processing personal information (EEA visitors only)

If you are a visitor from the European Economic Area, our legal basis for collecting and using the personal information described above will depend on the personal information concerned and the specific context in which we collect it.

However, we will normally collect personal information from you only where we have your consent to do so, where we need the personal information to perform a contract with you, or where the processing is in our legitimate interests and not overridden by your data protection interests or fundamental rights and freedoms.  We have sought to set these lawful bases out for each processing activity in detail in the table above.

If we ask you to provide personal information to comply with a legal requirement or to perform a contract with you, we will make this clear at the relevant time and advise you whether the provision of your personal information is mandatory or not (as well as of the possible consequences if you do not provide your personal information).

Similarly, if we collect and use your personal information in reliance on our legitimate interests (or those of any third party), we will make clear to you at the relevant time (or within the table above what those legitimate interests are.

Marketing

If you sign up to receiving marketing via the Websites, we and/or selected third parties may contact you with information about offers, products and services that might be of interest to you. We will get your express opt-in consent before we share your personal information with any third party for marketing purposes. If you no longer wish to receive marketing communications, please send us an email (using the details provided in the How to Contact Us section above) or click on the ‘unsubscribe’ link at the bottom of any of our marketing emails.

Aggregated data

We may collect, use and share “aggregated data” such as statistical or demographic data for any purpose. This aggregated data could be derived from your personal information but is anonymised and not considered personal information as this data will not directly or indirectly reveal your identity. For example, we may aggregate your usage data to calculate the percentage of users accessing a specific website feature.

Special category information

We do not generally seek to collect sensitive (or “special category”) personal information through our Websites but may do so as part of our business transactions. The special categories of personal information are information relating to racial or ethnic origin, political opinions, religious or philosophical beliefs, trade-union membership, health or sex life, sexual orientation, genetic or biometric information. If we do collect special category personal information, we will ask for your explicit consent, or rely on an alternative appropriate lawful basis (such as because the processing relating to personal information is manifestly made public) to our proposed use of that information at the time of collection. Security

We understand that the security of your personal information is important to you. When handling personal information, security is paramount and we seek to ensure that personal information is adequately and appropriately protected.  We use appropriate, technical and organisational measures to protect the personal information that we collect and process about you. The measures we use are designed to provide a level of security appropriate to the risk of processing your personal information. Data is encrypted both in transit and at rest and data access is restricted to authorised roles within the company only. Our data processing/storage standards and access regularly reviewed.

International Data Transfers 

We are a global business. This means that it may be necessary for us to transfer your personal information outside of the country in which it was collected, or your jurisdiction of residence, when transferring it to other entities or offices within Stats Perform and our service providers and business partners located in other countries. If you are based in the European Economic Area (“EEA”), your personal information may be transferred to or accessed from outside the EEA in countries which are not governed by data protection laws equivalent to those in force within the European Union (“EU”).

Specifically, our Website servers are located in the UK, and our group companies and third party service providers and partners operate around the world.  This means that when we collect your personal information we may process it in any of these countries.

However, we have taken appropriate safeguards to require that your personal information will remain protected in accordance with this Privacy Notice. These include implementing the European Commission’s Standard Contractual Clauses for transfers of personal information between our group companies, which require all group companies to protect personal information they process from the EEA in accordance with European Union data protection law.

We have implemented similar appropriate safeguards with our third party service providers and partners and further details can be provided upon request.

How Long We Retain Your Personal Information 

We retain personal information we collect from you where we have an ongoing legitimate business need to do so (for example, to provide you with a service you have requested or to comply with applicable legal, tax or accounting requirements).

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymise it or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

To determine the appropriate retention period for personal information, we consider the amount, nature and sensitivity of the personal information, the potential risk of harm from unauthorised use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.

  • In addition, if you are a resident of the European Union, you can object to processing of your personal information, ask us to restrict processing of your personal information or request portability of your personal information. Again, you can exercise these rights by contacting us using the contact details provided under the “How to contact us” section below.
  • You have the right to opt-out of marketing communications we send you at any time.  You can exercise this right by clicking on the “unsubscribe” or “opt-out” link in the marketing e-mails we send you.  To opt-out of other forms of marketing (such as postal marketing or telemarketing), then please contact us using the contact details provided under the “How to contact us” section below.
  • Similarly, if we have collected and process your personal information with your consent, then you can withdraw your consent at any time.  Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your personal information conducted in reliance on lawful processing grounds other than consent.
  • You have the right to complain to a data protection authority about our collection and use of your personal information.  For more information, please contact your local data protection authority.
